An Important Advisory to All Business Owners:In the business landscape, interacting with different departments is a given. However, a word of caution to all you entrepreneurs out there, especially those operating as sole traders or partnerships. I share this as a STRONG ADVICE to protect your venture and navigate the sometimes-stormy waters of business.Change your business structure to a COMPANY. This particular department has NO AUTHORITY over businesses registered as companies. Guard your interests, stay informed, and SHIELD YOUR BUSINESS. As a part of the entrepreneurial community, it is our collective responsibility to support one another and resist inappropriate bureaucratic conduct.The department under discussion has recently displayed an unsettling lack of professional integrity in their interactions with various small businesses. Their modus operandi, marked by intimidation and racial profiling, is deeply disturbing. Their conduct could be a looming threat for other businesses as well.

One of the most corrupt government bodies we have ever interacted with as a business.This Corrupt corrupt Government Specifically targets businesses Operated by Owners with Ethnic Backgrounds.Thus far they have harassed our employees using many intimidation techniques such as illegally asking them to show IDs, Racial Discrimination, hiring third party rogue investigators to stalk them at their homes, Tyranny at every turn when asked or requested for information Including the Legally binding Freedom Of Information Requests.I urge any business or personals having any friction with this department to report them to The Corruption & Crime Commission (CCC) as well as The Western Australian Ombudsman.Sinamon Will be fighting them with full force at the Courts alongside reporting them to these independent agencies.

In one documents they made 13 errors. They amended the errors but refused to change the decision. They are much much different with Fair Work. If you had experienced something unfair with them, we can set up a group to discuss and help each other. The Small Business Development Corporation can help nothing.

If you are sole trader you should be very careful especially your first language is not English. You owning evidence or witness couldn’t secure success because the commissioner has the right to use it or not, or retort it. All evidence including messages must be translated in English, if not the evidence may be not approved to use in later appeal. If you fail in the hearing, you can appeal to Full Buch while the members still are WAIRC commissioners. During Full Buch appeal you should speak concisely and not repeat details in previous hearing. The Full Buch only attention if the decision of the previous hearing has error in using law or evidence. If your appeal to Full Buch is refused you can continue to Industrial Relations Court. The court is independent and the member is not from WAIRC. Mostly the employees are regarded as Vulnerable Groups and there are not organizations or layers can help employers. The Small Business Development cannot provide legal help. If you are trading legally, if you are supported by most workers then there are chances and we can help each other. Someone from another commission advised when you prepare for a hearing or Full Bench appeal, you should make the paper work of hearing or appeal book as long as you can with all details and evidence. If the commissioner doesn't read the lengthy materials carefully and analyze it word by word as a lawyer, they will make a large amount of errors which can be used in later appeal as evidence. In Full Buch or Industry Relation Appeal you should speak in short words and make a summary with highlighted points to express their errors. Sometimes if you think your rights are infringed you can report to Australian Human Rights Commission, Equal Opportunity Commission, etc. After all you do as much as you can to avoid being neglected and hurt. The Industrial Relations Law gives WAIRC utmost rights, you have no chance if they read and research both parties' speaking in hearing and paper work carefully , if they make clear all details and make decision based on facts, but... If you are commissioner, will you read 20 pages paperwork word by word to avoid errors? I think only court and lawyer can do. Then do you think you have change?
